1. Who we are

2. When these terms apply
These terms apply to every proposal, every assignment and every participation in the Owned. partner programme. Deviations only apply if we have agreed on them in writing (including via WhatsApp or email).
3. What we do
We set up automated email flows in the client's Klaviyo account, such as abandoned checkout, abandoned cart and welcome emails, including copy, design and a sign-up popup. With Growth and Scale we also send and analyse campaigns during the first 30 days and optimise based on the numbers. Exactly what is included in your assignment is stated in the proposal you receive from us.
4. How the assignment is agreed
The assignment is final as soon as you accept our proposal and we have received payment.
5. Price and payment
The price is stated in the proposal. You pay in advance, by bank transfer or crypto. We start once payment has been received. All prices shown are final prices.
6. Delivery
We aim to have your flows live within 1 business day after receiving payment, access to your Klaviyo account and the required information. This is an aim, not a guarantee. When we're busy it may take longer; we'll let you know.
7. What we need from you
You give us access to your Klaviyo account and the information we need, such as your logo, brand style and discount code. You pay for Klaviyo and other tools yourself. You are responsible for having consent from the people you email, in line with privacy law.
8. No refunds
Because we start working for you right after payment and make everything custom, refunds after payment are not possible. If we don't deliver what is in the proposal, we'll fix it free of charge until it's right. Our services are intended for businesses. If you are a consumer, you agree that we start immediately after payment, and your right of withdrawal expires once the service has been fully performed.
9. Results
Calculation examples, the calculator and example figures on our website are estimates. Results depend on your product, price, traffic and market. We do not guarantee revenue or profit.
10. Ownership
After full payment, the flows, copy and templates we create for you are yours. You may keep using, editing and expanding them.
11. Liability
Our liability is limited to the amount you paid for the assignment in question. We are not liable for indirect damage, such as lost revenue, or for outages and changes at Klaviyo, Shopify or other parties.
12. Confidentiality
We only use information about your store to carry out the assignment. If we share results as an example, we do so anonymously unless you give us permission to use your name.
13. Partner programme
Partners receive their own code. Commission only counts once the referred client has paid and their flows are live. We pay out within 1–3 business days after that, by bank transfer or crypto. Commission is a percentage of the amount the referred client pays for their package: 20% (level 1), 25% (level 2) or 30% (level 3). The level is determined per calendar month. No commission is paid on monthly subscriptions or later purchases. When posting about Owned., partners make clear that it is advertising and make no promises we don't make. In case of abuse, such as fake clients or misleading claims, we may end participation and withhold commission.
14. Governing law
These terms are governed by Dutch law. Disputes will be submitted to the competent Dutch court. This is an English translation; in case of differences, the Dutch version prevails.
